Medical malpractice occurs in many different forms. It can occur either
from the nurse making a mistake, a doctor making a mistake, hospital
personnel making a mistake. But whenever anybody in the healthcare field
makes an error and a person is injured as a result of that that falls into
the category of a medical malpractice case, and in a medical malpractice
case there are three things that we have to prove.
We have to prove first of all, that the doctor, nurse, technician, whoever
it is, that they did something below what's called the standard of care,
which is determined by expert witnesses who we hire. We then have to prove
that that negligent act that occurred caused some injuries. Then the third
thing we have to prove, is what is the nature and the extent of those
injuries.
Whether it's pain and suffering, whether it's long term pain and suffering,
whether it's disability, whether they're going to need medical care in the
future, and also if they're not going to be able to work in the future. The

was actually injured, and then if the person is still alive then his or her
spouse can also be included in the medical malpractice case, for what we
call loss of consortium.
And loss of consortium is the injury and the loss that a non-injured spouse
suffers, as a result of the injuries that the injured spouse has, so
whenever somebody gets hurt and they're in a marital relationship, that's
